PostSubject: The U.S. Bill of Rights ( Applies to USA citizens).    Sun Jul 18, 2010 4:25 am

Amendment 1 - Freedom of Religion, Press, Expression. Ratified 12/15/1791. Note

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Amendment 2 - Right to Bear Arms. Ratified 12/15/1791. Note

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Amendment 3 - Quartering of Soldiers. Ratified 12/15/1791. Note

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

Amendment 4 - Search and Seizure. Ratified 12/15/1791.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Amendment 5 - Trial and Punishment, Compensation for Takings. Ratified 12/15/1791.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Amendment 6 - Right to Speedy Trial, Confrontation of Witnesses. Ratified 12/15/1791.

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

Amendment 7 - Trial by Jury in Civil Cases. Ratified 12/15/1791.

In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.

Amendment 8 - Cruel and Unusual Punishment. Ratified 12/15/1791.

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Amendment 9 - Construction of Constitution. Ratified 12/15/1791.

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Amendment 10 - Powers of the States and People. Ratified 12/15/1791. Note

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The reason I am posting this is because of a situation that has occured within the USA military. A Chaplain( Religious leader within the military) got into trouble because he said " In Jesus' name " while praying over a funeral. That is a violation of the first amendment. For members who live in the USA, I have decided to show you your constitutional rights in case the US government ever tries to violate your rights.

Oh, the US Bill of Rights does not apply to US citizens. It applys to the government. A US citizen can NOT violate the Constitution or Bill of Rights.

Ummm, Constitutionally, he is allowed to say in Jesus. He serves the Government, he is not a government official. He is a chaplin for crying out loud.

Side note: The US Bill of Rights does NOT apply to the State. The Supreme Court's Ruling using the 14th Amendment and saying it applys to the States is wrong. It was built to only Apply to the US government. The States have their own Constitution for that reason.

These amendments were meant to tell the government and the people the rights the people have. That means the government is not allowed to punish people as long as they invoke these rights. Since the military is a government organization, they are not allowed to punish anybody for saying a line from their religion as long as public safety is not threatened. So these rights apply to both the people AND the government. Since saying "In Jesus' name" puts nobody in danger, everybody has the right to say it. So the way the military treated the Chaplin was illegal.

Since it is a piece of local happening, the News section is more suitable to it. The discussion may be continued there.

By the way Mindrop, what do you mean that these rights don't apply to the citizens, but to the government? In the amendments, it only states them as 'right of people' or 'person'. That should mean any citizen should it not? If they were for government personnel only, they would have used the words 'government official', or 'government servant' would they have not?

These were set up to restrain the government. A citizen or soldier, except those in command, can not violate these rights.

Of course he cannot. When certain amendments are referring to soldiers, it says that they are referring to soldiers and militia. I'm talking about others which don't refer to them.

I am of the opinion that he actualyl did nothing wrong. As he does have rights to do that. And everyone from teh US should know these rights by memory that way they know them. Did you know also that you have to have a permit to assemble a group of people in a park? this also violates the first amendment as it states taht you can peacefilly assemble but the govt says you need a permit.

"How fortunate for leaders that men do not think." Adolf hitler said this quote and how true it is. People no longer think and just let the leaders lead the country how they want. If people were to stand up for their rights then these thigns would not happen.

If I could get enough people (roughly half the nation's population) I could start a movement. joke. People in America tend to be cowardly and let others think for them. I hope that will change oneday.
